Get a Passport On or After Probation or Parole

Learn how to apply for a U.S. passport if you are on or have completed probation or parole. Find out how to get your passport back after a court or law enforcement agency such as the police took it during a criminal matter at a U.S. court.

Getting a new passport and asking for us to return your passport are 2 different processes and depend if your passport is valid or expired.

Apply for a new U.S. passport

Apply in Person for a new U.S. passport and include additional documents if:

  • Your passport was sent to us by a court or law enforcement agency and it has expired.
  • You are on or have completed probation or parole.

You must include 1 of these documents with your passport application:

  • A discharge notice from your probation officer
  • A letter of termination from your probation officer
  • A court order ending your supervised probation or parole

Request the return of your valid U.S. passport

Follow the steps to request the return of your passport if:

  • Your passport was sent to us by a court or law enforcement agency and has not expired.
  • You are on or have completed probation or parole. · 
  • We cannot return your passport if it was revoked, expired, or you reported it lost or stolen.

To request the return of your passport, you must send us 2 documents:

  • Notarized letter requesting return of your passport.

  • Official letter from your probation officer authorizing the return of your passport.

Your notarized letter must include:

  • Name of the court or agency which took your passport

  • Your full name

  • Date of birth

  • Contact phone number

  • Mailing address

  • Social Security Number

  • Copy of valid, government-issued photo ID such as a driver’s license

The letter or email from your probation officer must give permission to return your valid passport and include:

  • Official letterhead or email address of the probation office

  • Probation officer’s signature

  • Officer’s phone number, government email address, and mailing address

  • Your scheduled probation completion date

If you completed probation or parole, you may submit a discharge notice or court order ending supervised probation or parole.
