Documents
Birth Certificates
Available. If a birth certificate (Certificat de naissance) already exists, the request should be addressed to the État Civil de Lomé (Mayor’s Office) for individuals born in Lomé, the capital city. Otherwise the request should be sent to the État Civil Mayor of the city of birth. In Lomé, records are available at the “État Civil Central, Commune de Lomé”. Neighboring districts of Lomé have stored their own archives since 1988. Prior to that the records were stored at the “État Civil Central.” The suburbs of Lomé (Baguida, Agoe Nyive, Afloa Sagbado, Amoutivé, Togblekope, Legbassito, Sangera) transfer their records to the general archives of the “État Civil Central, Préfecture du Golfe” at the end of each year; no records are kept on-site. In the absence of a birth certificate, a birth may be certified by two witnesses (other than the parents). A request for a birth to be officially recorded should be addressed to the Tribunal de Premiere Instance of the city of birth. For smaller towns, this request should be addressed to the prefecture having jurisdiction over them.
Marriage Certificates
Available. Marriage certificates are recorded by the État Civil of the town where the marriage took place. In Lomé, copies of these records are available at the “État Civil Central, Commune de Lomé”. Togolese law allows a traditional, customary marriage to become legalized by recording it into the official registers of the État Civil of the current residence of the spouses. Note: Only the declaration date is reported on the transcription and not the date when the customary marriage took place.
Divorce Certificates
Available. Divorces must be legally formalized and carried out by a judge. The court of the residence of the spouses pronounces divorce decisions, and a transcription is physically made on the marriage certificate at the Mayor’s office where the marriage was originally carried out. Parties can either present the court’s decision for the proof of divorce or have the État Civil of the town where they were married issue a divorce certificate (Certificat de divorce). Togolese law does not make a provision for divorces of traditional, customary marriages that were never legalized. In the absence of a divorce decree, the spouses are considered separated, but not divorced.
Death Certificate
Available. (Certificat de Décès). This request should be made to the État Civil of the place of death. For Lomé, records are available at the “État Civil Central, Commune de Lomé”.
Certificate of Legitimation
This certificate does not exist in Togo as children born in or out of wedlock are not treated differently under law.
Change of Name
Names can be changed legally by the judicial authorities in each town, or at the prefecture having jurisdiction over smaller localities. A written request must be submitted to the Minister of Justice. The General Secretary will submit the request to a judge having ultimate authority. Records of name changes are kept at the “Tribunal de Premiere Instance, 4eme Chambre Civile” in Lomé.
Police Record
Same procedure for prison record, although the prison record carries more legal weight in Togo.
Prison Record
Available. For Togolese nationals, requests for prison records (Extrait du casier judiciaire) are addressed to the bailiff (Chef Greffier) of the tribunal of his/her place of birth or the prefecture having jurisdiction over his/her place of birth. For foreigners living in Togo, this document is called the “Attestation de Non Condamnation.” The request must be addressed to the “Cour d’appel de Lomé”.
Military Record
Available. Requests should be addressed to the État Major, Premier Bureau, B.P. 938, Lomé.
Passports: Information on Travel Documents
The old version of the Togolese passport is no longer valid as of November 1, 2000. Togo has issued new regular, official and diplomatic passports. Although Togo has an agreement with the U.S. to allow for an automatic six-month extension of passport validity, visas should no longer be placed into the old-style passports.
