Documents
Birth, Marriage, and Death Certificates
Available. Birth (Izvod od Maticna Kniga na Rodeni), Marriage (Izvod of Maticna Kniga na Vencani) and Death Certificates, (Izvod od Maticna Kniga na Umreni) are available from the civil registrar (maticar) having jurisdiction over the locality where the event occurred. A marriage which took place by proxy is not usually evident from the marriage certificate. Prior to May 10, 1946, these records were maintained by orthodox church authorities. Since that date, only civil marriages have been legal. The orthodox church continues to issue birth and marriage certificates, but these are not legal until the event is recorded with the appropriate registrar's office. They are called svidetelstvo za sveto krstenie (birth certificate) and svidetelstvo za sveto vencanie (marriage certificate).
Divorce Certificates
Available. Copies of divorce judgments are available from the municipal court (osnoven sud) that decided the case. A divorce certificate is typewritten and headed "In the name of the citizens of the Republic of Macedonia" (vo imeto na gragjanite na Republika Makedonia). Since May 10, 1946, only divorces obtained through the civil courts have been legal. Prior to this date, divorces granted by church authorities were also recognized.
Identity Card
Available. All Macedonian residents age 18 and over must carry an identity card (licna karta) issued by the Ministry of Internal Affairs (Ministerstvo za Vnatresni Raboti). Application should be made at the local police station. It contains the photograph, date, and place of birth, and the address of the bearer. Normal processing time is five working days. Fee: 50 denars for administrative processing and 100 denars equivalent in tax stamps (available for purchase at any kiosk).
Statement of Unmarried Status
The civil registrar (maticar) having jurisdiction over a person's residence will issue a certificate stating that the applicant is or is not married (uverenie za bracna sostojba).
Note: Non-residents must apply for these documents through a Macedonian diplomatic mission. They are unlikely to receive a reply if they write directly to the issuing office. Macedonian consular offices throughout the world are supplied with the appropriate forms for obtaining civil documents. The request will be forwarded to the Ministry of Foreign Affairs for transmission to the office responsible for the issuance of the required document. The document will then be returned to the applicant via the Ministry of Foreign Affairs and the Macedonian Diplomatic Mission overseas.
The above procedure can be lengthy. All applicants are encouraged to attempt, at the same time, to obtain the required documents through a family member, friend or lawyer residing in Macedonia, who could apply personally at the office which issues the documents.
Court Certificates
Available. In 2008, a law was passed which transferred the authority to perform records checks for prior convictions from local police departments to the Basic Courts in each district. This transfer is being gradually implemented by local municipalities but is not complete. Until such time as the transfer is complete, both a police record and court certificate is necessary to ensure that a person has no prior criminal convictions.
The court certificate (sudsko uverenie) is issued by the Basic Court (Osnoven sud) of the district in which the applicant currently resides (or last resided) and indicates whether the person has been convicted and/or sentenced in a court or if a verdict was rendered against the person for any crime which carries a potential sentence of a monetary fine or imprisonment of up to three years. The certificate may be obtained in about two days and there is a fee of 400 denars. Macedonian citizens not physically present in Macedonia may apply for the court certificate through Macedonian diplomatic or consular representatives abroad.
Police Records
Available. In 2008, a law was passed which transferred the authority to perform records checks for prior convictions from local police departments to the Basic Courts in each district. Until such time as the transfer is complete, both a police record and court certificate are necessary to ensure that a person has no prior criminal convictions.
A police record may be obtained for all persons aged 14 years or more which indicates any prior criminal convictions (Uverenie za neosuduvanost). Applications should be made to the main police department which has jurisdiction over the person’s place of residence. The certificate can usually be obtained in two to four days and there is a 50 denar fee. Macedonian citizens not physically present in Macedonia may apply for the police certificate through Macedonian diplomatic or consular representatives abroad. Police certificates are not available for foreigners who live or who have lived in Macedonia.
The police certificate is supplemented by a court certificate showing current investigations. It is issued by the municipal court which has jurisdiction over the person's permanent residence. Fee: 400 denars.
Prison Records
Available. A statement of the time spent in a correctional institution can be obtained from the prison in which a person was confined.
Military Records
Unavailable. A military card (voena kniska) is issued to all persons who have served in the Macedonian armed forces. Records may also be obtained from the district branch office of the Ministry of Defense (Podracna Edinica) having jurisdiction over the individual at the time of service. There is no fee for this service.
Special Clearance and Issuance Procedures
On June 26, 2001, the President signed a 212(f) proclamation for the Western Balkans. This proclamation gives authority for suspending the entry of certain categories of individuals into the United States. The proclamation states that these categories include those "who seek to undermine peace, stability, reconciliation or democratic development in any area or state of the Western Balkans region." Although no specific nationalities are named, the primary targets of this proclamation are individuals who have been identified as obstructing the Dayton Peace Accords in Bosnia and Herzegovina and those who are seen to be attempting to destabilize Kosovo and Macedonia. In addition, those believed to be responsible for wartime atrocities in the region since 1991 are also included under this proclamation.
VO enters the names of suspected offenders into CLASS. As with any "00" hit, posts are expected to send in a Security Advisory Opinion (SAO). These SAOs should be in Donkey or Bear format as appropriate and should be slugged for CA/VO/L/C and EUR/SCE. The Department's response is required to visa issuance. In addition, there may be individuals who are not in CLASS, but about whom posts may have suspicions. Posts are encouraged to send in SAOs to VO/L/C for anyone whom they believe may be affected by the limitations of the 212(f), regardless of the results of the CLASS name check.
