Marriage Certificates - All Australia

Available. Application for marriage certificates should be made directly to the Registrar of Marriages in the State or Territorial capitals.

Divorce Decree - All Australia

Available. The law and practice in respect to the issuance of divorce decrees absolute vary in each State or Territory. The general procedure is to issue a formal document to the person seeking the relief (that is, the petitioner or plaintiff). The respondent may obtain a copy. The usual practice is to supply copies of decrees absolute, or certificates that a decree has been made absolute, to parties to the suit only.

Court Records - All Australia

Available. Whereas a police certificate will show the offense committed and the penalty imposed, it will not show the section of law under which convicted, nor the value of any goods involved. Applicants can obtain Certificates of Conviction by writing directly to the court involved, giving the full name, the nature of the offense, and the date of the court appearance that will show on the police certificate. The fee varies and the specific information required should be requested. Some courts destroy or retire minor records after a number of years, but the court can confirm that the record is unavailable. Verbatim transcripts are available in some cases.

Military Record - All Australia

Available. A military discharge certificate issued by any branch of the armed forces prior to 1991 will normally state the length of service and indicate whether the discharge was honorable or not. If the discharge certificate has been lost, or does not indicate whether the discharge was honorable or dishonorable, an applicant may write to the relevant branch of the armed forces that will issue a letter providing this information:

Police Certificates - All Australia

If you reside outside Australia

Applicants who live overseas should refer requests to the Australian Federal Police.  Applicants are required to apply for a police certificate based on a name and fingerprint check.  Police clearances issued on the basis of only a name check will not be accepted.  More information is available on their website at: http://www.afp.gov.au/ or via e-mail at vetting@afp.gov.au.      

If you reside in New South Wales

Make an appointment, and then appear in person to be fingerprinted at your local police station. You must pay the fee of AUD175 (subject to change, please check the current fee with the police) and complete an application form, which the police will forward to:

If you reside in Queensland

Check with your local police station if you need an appointment, then go in person to be fingerprinted. You must pay the prescribed fee of AUD146.70 (subject to change, please check the current fee with the police) and complete an indemnification form required by the Queensland Police Department. You must then forward the fingerprints, completed indemnification form, and payment to:

Return of police certificates for NSW and Queensland residents

For NSW and Queensland residents, your police record will be sent directly to the U.S. Consulate in Sydney by the police department, and the Criminal Records Section will notify you that this has been done. If you do not receive this notification within 3 weeks of your application, we strongly recommend that you ascertain the status of your records by checking at the police station where you initially made your request.

If you reside in the ACT

Check with your local police station if you need an appointment, then go in person to be fingerprinted. You must also pay the prescribed fee. Current fees can be found at the AFP website.You must also complete an indemnification form required by the Australian Federal Police. This process normally takes a minimum of 15 working days, after which the results are posted to the applicant. You must then bring the results to your final visa interview at the U.S. Consulate General in Sydney.

If you reside in Western Australia

If you reside in Western Australia, you must request a national police certificate based on name and fingerprints from the Australian Federal Police (AFP).  Check with your local police station if you need an appointment, then go in person to be fingerprinted.  Your fingerprint card, fees and application should be sent to the AFP for processing.  For current fees to be paid to the AFP, please refer to their website.  This process normally takes a minimum of 15 working days, after which the results are posted to the applicant. You must then bring the results to your final visa interview at the U.S. Consulate General in Sydney.

Overseas applicants must apply directly to the Australian Federal Police (AFP).

Victoria Police provide a Police and Fingerprints Records Search.  Fingerprints can be taken by appointment at any police station or at the Victoria Police Centre at 637 Flinders Street, Melbourne.  Appointments can be made by phoning 03 9247 5622. A Police and Fingerprints Records Search costs AUD123.40 (subject to change, please check with the police directly), and processing time is a minimum of 10 working days.

If you reside in Tasmania

Criminal History Services provides a National Police History Record & Fingerprint Check, but you must be residing in Tasmania to apply.  Residents of other states should direct enquiries to the police service of the state or territory in which they reside.

Applicants are required to submit copies of 3 different types of ID with their application form, and must attend their local police station to take fingerprints.  The fee for a National Police History Record & Fingerprint Check is AUD120 (subject to change, please check with the police directly) and the average turnaround time is 3-4 weeks for a fingerprint check.

If you reside in the Northern Territory

A fingerprint check is AUD120 (subject to change, please check with the police directly) and the turnaround time is 4 weeks for fingerprint checks.  The fingerprint check will include disclosable traffic convictions and criminal records held by the Northern Territory and most interstate police jurisdictions. Applicants must visit their local police station with their ID.  Please call ahead to check if you need an appointment.

National Police Certificate & Fingerprint Checks (NPC) will only be prepared for those people who reside in South Australia.  South Australian residents living overseas should refer requests to the Australian Federal Police or via e-mail at vetting@afp.gov.au.  Residents of other states should direct enquiries to the police service of the state or territory in which they reside.

The standard timeframe to process a NPC is between 2-15 working days. The fee for a National Police Certificate & Fingerprint Check is AUD142.50 (subject to change, please check current fee at SA Police website).

Australian Capital Territory

Birth, Death and Marriage Certificates
Available from the Office of the Registrar of Births, Deaths, and Marriages, P.O. Box 788, Canberra City ACT 2601. The request for a certificate should include the complete name of the requester, parents' names (including mother's maiden name) and the date and place of the action, i.e., birth, marriage or death. Requests for marriage certificates must include full information about both parties to the marriage. There are two types of certificates: the ‘full certificate’ and the ‘extract form’. There is a fee for the full certificate and an additional fee for priority issuance (24 hours) It is necessary to obtain the full certificate, since this will contain biographic details not shown on the extract form. Requests for certificates normally take 5-10 working days to process. All requests for certificates should contain the requester’s relationship to the subject and the reason for the request.

Divorce Record
Available. When a Decree Nisi is made absolute, a certificate may be obtained from the Registrar of the Court in Canberra that granted the decree. This will be either the Family Court of Australia - Canberra Registry, or the Supreme Court of the ACT. Additional copies of the certificate can be supplied if one is lost or destroyed. Information in respect of decrees absolute of dissolution or annulment of marriage may be obtained from the Registrar in Divorce, Supreme Court, Canberra.

Police Record

Procedures to be followed for visa applicants both inside and outside the country who wish to obtain clearances:

  • Inside: The applicant may write or apply in person to have his/her fingerprints taken at the City Police Station, London Circuit. Canberra, Act 2601. Telephone no. (02) 6256-7777.
  • Outside: Applicant must write the station with a formal request, using the forms on the AFP website www.afp.gov.au. Applicants must go to a local police station in their country of residence, acquire a certified fingerprint form, and send this with an official request to the City Police Station.

New South Wales

Birth, Death, and Marriage Certificates
Available from the Principal Registrar of Births, Deaths and Marriages, G.P.O. Box 30, Sydney, N.W.W. 2001. Adoption Record
Unavailable. In New South Wales, Adoption Orders are made in the Supreme Court of New South Wales, Equity Division. The Court does not issue a copy of the Adoption Order to the adoptive parent(s). The Court sends a Memorandum of Adoption to the Principal Registrar of Births, Deaths and Marriages in New South Wales, and a further copy is provided for the similar authority if the child was born in another State or Territory of the Commonwealth of Australia.

The Principal Registrar can only issue a birth certificate in the child's "adopted" name showing the adoptive parents as natural parents. The new birth certificate is not distinguishable from any other original birth registration, and gives no evidence of adoption.

In order to meet other requirements of the Immigration and Naturalization Service in processing the I-600 petition, the adoptive parent(s) should write to the adoption authority in New South Wales. A statement that the adoption was finalized should be requested, and that the natural parent(s) did, in fact, irrevocably release the child for adoption prior to the making of the Order of Adoption. There are cases, however, where the Court can dispense with the written consent of the natural parent(s) and still allow an Order of Adoption of full force and effect to be made. These children may actually be orphans, wards of the State, or the surviving parent(s) may be incapable of making a decision to release the child for adoption. Post has been unable to definitively ascertain how specific the information furnished will be without referral to a particular case.

Divorce Decree
Available. Copies of decrees for divorce actions filed prior to June 1, 1976 can be obtained by writing to the Supreme Court of New South Wales, Family Law Division, G.P.O. Box 3, Sydney, N.S.W. Copies of a divorce filed subsequent to January 5, 1976 can be obtained by writing to the Family Law Court of Australia, G.P.O. Box 9991, Sydney, N.S.W. 2001 or to the Family Law Court of Australia, P.O. Box 399, Parramatta, N.S.W. 2124. Persons desiring copies of decrees should furnish the full names of the parties involved and the dates and place that the proceedings were commenced, and when the decree was granted.

Procedures to be followed for visa applicants both inside and outside the country who wish to obtain clearances:

  • Inside: Applicant must reside in New South Wales and apply in person at the police station nearest their place or residence. Applicant must complete New South Wales Police Form P397A that can ONLY be obtained from their local police station.
  • Outside: NSW applicants residing outside of Australia must apply for their Australian police certificate through the Australian Federal Police in the ACT. Applicant should visit AFP's direct site to download the instructions and forms for a Criminal History Check. Applicant is required to submit a set of fingerprints. The fee is AUS $103.00 to apply for a Fingerprints and Name Application. Please follow AFP's instructions carefully and supply all documents that AFP requires.

Court Record
Available. Applicants should communicate directly with the Clerk of the Court where the conviction occurred. In submitting a request, the full name of the person should be furnished, the date the conviction occurred and the nature of the offense. Northern Territory

Western Australia

Birth, Death, and Marriage Certificates
Available from the Registrar General, Westralia Square, 141 St. George's Terrace, Perth WA. 6000. (P.O. Box 7720, Cloisters Square, Perth, WA 6850). Processing time: Approximately 1 week. There is a search fee for each 5 years and a fee for extra copies of documents. Also, fees vary for either a certified copy or an extract copy.

Divorce Record
Available from the Family Court of Western Australia, 150 Terrace Road, Perth, WA 6000 or Supreme Court, Stirling Gardens Barrack St., Perth, WA 6000, depending on which court adjudicated the divorce. Divorce applications filed before June 1, 1976 may be obtained from the Supreme Court. Divorce applications after that date may be obtained from the Family Court.

Police Certificate
Certificates are available, but only through the Australian Federal Police (AFP), at the cost of $103.00. Procedures to be followed for visa applicants both inside and outside the country who wish to obtain clearances:

  • Inside: Applicant can provide their own fingerprints which is usually completed by the Western Australia (WA) Police Service (a courtesy type role that WA police provide, however, it is not specifically their task). If this is the preferred option, the applicant is provided the appropriate paperwork and contact details for the AFP Canberra office for which the applicant will be required to send the information, fingerprints and fee.
  • Inside (Alternative): an applicant can have fingerprints taken at the AFP office in Perth for which the fee is paid and the AFP Perth office facilitates the full process of sending the information, fingerprints etc to the AFP office in Canberra. To be fingerprinted, an appointment must be scheduled in advance.The required form may be acquired calling 02-6256-7777 or through the AFP's website at www.afp.gov.au.
  • Outside: Same as above. The only difference is that the applicant must go to a police station in their country of residence in order to get a fingerprint record. They must send all the aforementioned items as well as a copy of their passport as proof of identification to AFP Canberra.

Norfolk Island

Birth, Death, and Marriage Certificates

The request for a certificate should include the full name of the requester, parents' names (including mother's maiden name), and the date and place of the action, i.e., birth, death, marriage or divorce. Requests for marriage or divorce certificates must include full information about both parties to the marriage/divorce.

Divorce Record
Available. Obtainable from the Clerk of the Court of Petty Sessions. Full details including names of parties to the divorce and the date it occurred must be furnished.

Police Certificate
Available from the Officer in Charge of Police, Taylor's Rao, Norfolk Island via International Mail Centre 2899. In requesting the certificate, the person's full name, date and place of birth must be furnished.
